Many divorce lawyers use protective orders as a weapon in a divorce action. At The Barbknecht Firm, P.C., we often recommend reasonable protective orders as a shield for our clients to prevent their spouses from doing something stupid.

Here are some examples of things we put into a reasonable protective order to protect our clients' financial interests as well as their physical and emotional security:

  1. Community assets should not be wasted. (In other words, don't drain the savings account.)
  2. Children should not be removed from Texas.
  3. Children's education should not be interrupted.
  4. Bills on the homestead should be paid.
  5. One spouse should not harass the other at work.

A protective order is an insurance policy. Generally they are imposed while the divorce is pending. How intrusive and detailed they are depends on the couples and the lawyers. Protective orders are best used as a way to protect the status quo and not to exacerbate the situation. A reasonable protective order covers the kind of responsible behavior that everyone should follow anyway. Therefore, to obtain a reasonable order of protection, you do not need to provide evidence to the court.

Injunctions
An injunction provides longer-term protection and is intended to cover situations of stalking, protection from abuse and domestic violence. To obtain the long-term protection of an injunction against your spouse, you need to provide evidence to the court. The more intrusive and extensive the injunction, the greater the burden of evidence you need to provide.
