If something in your divorce agreement is not working, you may be able to modify the agreement. At The Barbknecht Firm, P.C., our lawyers are experienced in helping clients obtain court-approved modifications to their divorce agreements.

There are many circumstances when Texas courts will approve a modification to a divorce decree:

  • The payer of child support has lost his or her job, or has taken a lower paying job, and as a result can no longer afford to provide the same level of support agreed to. Agreement Incident to Divorce (AID) was in place, this also could be modified if there is a significant reduction in income.
  • The payer of child support is earning substantially more money and can afford to pay more child support.
  • The possessory parent has taken a job that requires him or her to move out of Texas, or to travel extensively.
  • One of the parents undergoes a change in circumstances, and as a result of this change the children could benefit from more - or less - contact with the parent.
  • The needs of a child have changed.

It's important to contact an attorney as soon as a change in circumstances occurs. A change in your divorce agreement - whether it is an increase or decrease in child support, an increase or decrease of child visitation, or a change in custody - would not take effect until approved by a judge.

Example
If you lose your job and need to reduce your child support payments, the change in child support payments will take effect the date the judge approves the modification. The new support, visitation, or custody will take effect on the date approved by the court and will not be retroactive to the date of changed circumstances.
