    If you are thinking of moving out of state, you must seek modification of your child custody order before you relocate with your child. The court will consider several factors in determining whether to allow the relocation, including:

    • The circumstances surrounding the move, including the noncustodial parent's existing relationship with the children and the custodial parent's reason for moving
    • The age and educational needs of the children, including educational opportunities in the new location and the effect on the children's religious and community involvement and participation in extracurricular activities, if any
    • Difficulty for the noncustodial parent to travel to the new location and be involved in the children's life
    • Proximity to other family members

    If the court allows relocation, the parents must agree to a new parenting plan that takes into account issues related to visitation with the noncustodial parents, such as travel arrangements and practical visiting schedules.
